Please review the terms and condition governing this site carefully as your use of the site indicates your acceptance of these terms and conditions, and your agreement to follow and be bound by them.  Do not use the site if you do not agree to be bound by these terms.  Please note that we may also periodically change the terms, without notice, so kindly check them from time to time as your continued use of the site signifies your acceptance of any changed terms.

Introduction
Welcome and thank you for using the GreaterGood South Africa.co.za site ("the site"). The site incorporates both The GreaterGood South Africa Trust donations information and processing site; and The Good Shop, a not-for-profit Section 21 home shopping site that markets and sells the products of Non Profit Organisations.

Unless the context otherwise indicates, references to "the site" are deemed to include both of these entities as "The GreaterGood SA entities".
 
The site is hosted and managed in the Republic of South Africa and aims to promote a culture of philanthropy and expand the communications between non profit organisations and the general public by facilitating all forms of donation, as well as the sale of goods manufactured by Non Profit Organisations. 

Donations through, and/or purchases made from the site are subject to the terms and conditions of this Agreement, to the exclusion of all other terms. By shopping or browsing on this site, you acknowledge that you have read, understood and agreed to be bound by this Agreement, and the other policies displayed on this site.
 
For the purposes of this Agreement the terms "our", "we" and/or "The GreaterGood South Africa entities" shall mean The Greater Good South Africa Trust or The Good Shop.

Information
While we make every reasonable effort to ensure that information provided about Non Profit Organisations listed on this site is accurate and current, you should not assume that the information provided is always current or that this site contains all the relevant information available.

Your Comments
We value your comments, ideas, suggestions and feedback in connection with your use of the site but neither The GreaterGood South Africa Trust nor The Good Shop shall be obliged to respond to, maintain or compensate you in any way whatsoever for your comments.  Once submitted or offered, your comments shall become the property of the entities which shall thus exclusively own all such rights, title and interests in the comments and shall not be limited in any way in its use, commercial or otherwise, of any of the comments.

You warrant that the comments submitted by you to the site do not and will not violate any right of any third party, including copyright, trademark, privacy or any other personal or proprietary right. You agree not to submit or offer any comments that will be or will contain any defamatory, unlawful, abusive or obscene material. The GreaterGood South Africa Trust and/or The Good Shop disclaim any liability towards any third party regarding your comments and you shall remain accountable towards any third party regarding the contents of your comments.

Customer Service
You and your personal charity choice are the most important part of the www.GreaterGoodSA.co.za service and we would like to ensure that your experience is positive and that your donations are well used.  We are committed to providing you with a free and easy way to make a difference through your everyday online activity, and to working as far as possible to meet your individual needs and preferences.  Should you be dissatisfied with any part of the www.GreaterGoodSA.co.za service, or with any product purchased through www.GreaterGoodSA.co.za., our client service representatives are available to provide support and to ensure, as far as possible, that your satisfaction is achieved.

All beneficiaries on www.GreaterGoodSA.co.za must commit to providing the GreaterGood South Africa Trust with their annual audited financial statements and an annual narrative report each year.  In addition, all beneficiaries must commit to providing us with detailed reports and accounts on the support they have received.  These will be verified by the GreaterGood South Africa Trust team and will be posted, together with photographs, in the Cause Reportback pages on www.GreaterGoodSA.co.za so that you can see how your support has contributed to the Greater Good of your cause of choice and for all in South Africa.  Where you have requested copies of the report, these will be emailed directly to you.

Privacy Policy
www.GreaterGoodSA.co.za, The GreaterGood SA Trust and The Good Shop deeply respects the privacy of its visitors and any information that you provide to us is stored on a secure server.  Our secure server encrypts your identity number and Payment Card details so as to minimise the risk of unauthorised disclosure or interception.  The GreaterGood South Africa Trust and The Good Shop will make sure that your personal information is kept strictly confidential and is not disclosed to any third parties.  We will not sell or rent personal information about you (such as name, address, email address, telephone or fax number), your cause selection, shopping preferences or other personally identifiable information with any third party, with the exception of your preferred cause, and then only if you have indicated that you would be happy for us to do so.  We do however reserve the right to disclose information regarding our members and usage of the site to each other and, amongst others, business partners and affiliates, including, but not limited to, the GreaterGood South Africa Trust and/or The Good Shop, registered NPOs listed on the site, our advertisers, suppliers and other selected third parties.

If you have chosen to subscribe to our newsletter, we will be informing you on a regular basis about new causes or products that become listed on the site, as well as any product promotions, special offers, or additions to the website.  If you enter any competition on www.GreaterGoodSA.co.za, we may ask for your name, address, and email address so we can administer the competition and notify the winners.  We will, however, only contact you with news of GreaterGood South Africa and/or its listed charities, including information about special offers and promotions, if you've indicated you would like to receive our newsletter at registration.
 
We do, however, reserve the right to, and may, release account information when we believe, in good faith, that such release is reasonably necessary to a) comply with law, b) enforce or apply the terms of any of our user agreements, or c) protect the rights, property or safety of GreaterGood South Africa, our users, or others.

Intellectual Property
The GreaterGood South Africa entities retain all copyright in all material, including logos and other graphics, which form part of the site.  All data and information communicated to or from the site and/or any site information and database remain and shall be the sole property of the GreaterGood South Africa entities and/or the listed NPOs supported by the site.

The GreaterGood South Africa entities grant you permission to view, electronically copy and print in hard copy portions of the site for the sole purpose of browsing the site, supporting a Non Profit Organisation and/or purchasing any products from The Good Shop, for your personal use only.  Any other use of the information, graphics or materials on the site, including reproduction, modification, distribution or reproduction for purposes other than those indicated above and without the prior written consent of the GreaterGood South Africa entities and the lawful trademark and/or copyright owner (if applicable) is strictly prohibited and constitutes an unlawful infringement of the intellectual property rights of the relevant GreaterGood South Africa entities and/or such trademark and/or copyright owner.

Trademarks
"GreaterGood South Africa", "The Good Shop", "Experience the Gift", "Good Gifts Gift Vouchers" and all other marks, logos and trade names appearing on this site are trade mark of the relevant GreaterGood South Africa entities or their associated organisations in the Republic of South Africa and in certain other countries. Nothing contained on this site should be construed as granting, by implication or otherwise, any license or right to use any of the trademarks displayed on this site without the express prior written consent of the relevant GreaterGood South Africa entity or other listed organisation. Your use of any of the trademarks displayed on the site is strictly prohibited.  You may not copy, reproduce, publish, upload, post, transmit, distribute or modify any logos or trademarks appearing on this site. You further undertake not to infringe any right of the GreaterGood South Africa entities or their associated organisations in respect of such trademarks. The GreaterGood South Africa entities do not warrant that the functions provided by the site will be uninterrupted or error free, or that the site or the server that makes it available are free from viruses or other harmful components.
 
Save as expressly set out herein, the GreaterGood South Africa entities shall under no circumstances whatsoever be liable to you as a result of or in connection with the GreaterGood South Africa entities' negligent (including grossly negligent) acts or omissions or those of their employees, agents or designees or other persons for whom they may be liable in law, for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused (whether from contract, delict or otherwise and whether actually foreseen or reasonably foreseeable), sustained by you, the recipient of the Products or services, or any other person arising from or as a result of any use or sale concluded in terms of this Agreement, the delivery, non-delivery, incorrect, erroneous or late delivery, the use, possession or consumption of the products or services as supplied through this site.
 
The GreaterGood South Africa entities, their directors, employees, designees, agents, representatives, affiliates and suppliers shall not be liable for any loss, damage (whether direct, indirect or consequential) or expense of any nature whatsoever which may be suffered as a result of or which may be attributable, directly or indirectly, to the use of or reliance upon this website (including any information contained thereon) or the Internet.
 
You will indemnify the GreaterGood South Africa entities and keep them fully indemnified from and against any loss or damage suffered or liability incurred, including without limitation in respect of any claim or demand by any third party by reason of any act or omission on your part or that of any family member, agent or representative acting on your behalf in connection with transactions concluded on the site and/or in terms of this Agreement and/or in relation to receipt of products or services supplied by the GreaterGood South Africa entities pursuant to any such order placed through this site or through any other means.
 
Notwithstanding any other provisions contained herein, the GreaterGood South Africa entities' liability whether in contract or delict arising from any breach of any obligation in terms of this Agreement, negligence or otherwise shall not exceed at any time more than the monetary value of the order in respect of which any such dispute or claim arises.

General Terms
The content contained on the site may be used by you for your own personal, non-commercial shopping and information purposes only. In using the site you agree not to infect it with any computer programming (such as a virus) that may damage, interfere with, delay or intercept any data or information on the site and you shall indemnify the GreaterGood South Africa entities for any damage caused by any such act attributable to you.  The GreaterGood South Africa entities may suspend the site or any part thereof should they determine that you are not using the site in compliance with this agreement or if the GreaterGood South Africa entities believe the information provided by you is untrue, inaccurate or incomplete.

If any provision of this Agreement is unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining terms.  This Agreement constitutes the whole agreement between the parties.

Any indulgence granted by any GreaterGood South Africa entities to you shall not be construed as a waiver or variation of any of the rights or remedies under this Agreement.
 
At the option of any GreaterGood South Africa entity, any dispute arising out of this Agreement may be brought in any Magistrates' Court of competent jurisdiction notwithstanding that the amount in issue may exceed the jurisdiction of such court.  This Agreement is governed by the laws of the Republic of South Africa.

Donations and/or shopping terms
Registration and/or use of any donations and/or shopping functions on this site constitutes acceptance of this Agreement and all its terms, conditions and policies by you.  These terms and conditions shall apply to any transaction between yourself and the GreaterGood South Africa entities which reserve, at all times, the right to amend these terms as it may see fit, and any such amendments shall be deemed to apply as between yourself and The GreaterGood South Africa entities.  Amendments will take effect immediately on posting of the amended terms on this site.

To make donations or purchases through The www.GreaterGoodSA.co.za website using loyalty programme points, you must be over the age of 18 (eighteen) and be the holder of a valid MasterCard or Visa Card or a member of American Express Membership Rewards or eBucks.
 
To register you will be required to provide certain information including personal details, Payment Card details and your delivery address.  When registering you will be required to choose a password which you must keep secret at all times.  You will be required to enter your password each time you visit the www.GreaterGoodSA.co.za site.  The GreaterGood South Africa entities accept no liability for any damages suffered or losses incurred from the use or misuse of your Password.

Security Policy
Once you have registered with www.GreaterGoodSA.co.za, your personal details can only be amended by using your chosen password.  We suggest that you keep this password private to ensure that no one else can gain access to your information.  You can change your password at any time by visiting My Account.

Donating or ordering online at GreaterGoodSA.com is entirely safe and very easy and offers the latest in secure transaction technology. www.GreaterGoodSA.co.za takes every precaution to protect your payment details.  However, it is your responsibility to notify your credit card provider of the unauthorized use in accordance with its reporting rules and procedures.  If any unauthorized charge appears on your credit card as a result of a secure credit card transaction at a www.GreaterGoodSA.co.za charity or retail outlet, you must report this directly to your Card Provider.
 
On ordering, where you are asked to enter your card information, that information is encrypted and protected with the best encryption software in the industry - SSL (Secure Socket Layer). (While on an encrypted page, the lock icon at the bottom of browsers such as Internet Explorer and Netscape becomes locked.)  Furthermore, your payment information is never stored on our servers. www.GreaterGoodSA.co.za is backed by GeoTrust (http://www.geotrust.com).
 
Whilst the GreaterGood South Africa entities will endeavour to ensure that your personal information and/or credit card details are protected as they travel over the Internet, there is no 100% secure transmission of data on the Internet given the current state of Internet technology. Therefore the GreaterGood South Africa entities cannot guarantee the absolute security of any information you transmit to us or which we transmit to you.

Product Sales
All products displayed on this site are subject to availability and will be delivered only within the Republic of South Africa unless otherwise specified and agreed upon by The Good Shop in writing. All prices displayed on the site are quoted in South African Rands and are valid and effective only in the Republic of South Africa. The Good Shop reserves the right without prior notice to discontinue or change specifications on products and services offered on this site without incurring any obligations.

Order Enquiries
Items purchased in The Good Shop are all high quality handmade products manufactured by various Non Profit Organisations as part of their sustainability and income-generation strategies.  These initiatives ensure that each organisation can become independent and economically productive and the income generated is used to further their mission and work for the GreaterGood of South Africa.

GreaterGood South Africa aims to assist these organisations not only by marketing their products on a broad basis, but also with the establishment of product manufacturing funds that will enable them to develop a supply of stock for responsive sales and marketing to the public.  Orders may be subject to an order period time although where items are in stock, delivery could be effected within 5 to 10 working days.

Stock Availability
The Good Shop cannot always guarantee availability of stock.  If we are unable to supply each and every item ordered or in the quantities ordered, we will contact you directly to seek alternatives and/or conclude whether the balance of items ordered should be delivered and/or the additional items be ordered for you for later delivery.  Should you notwithstanding a delay in certain items still agree to accept delivery, you will be liable for payment for the items correctly delivered as per any amended order and applicable invoice.

Product Colours
We have made every effort to display as accurately as possible the colours of the products that appear on the site. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

Pricing Policy
You will be charged the prices as they are reflected on the products in The Good Shop at the point of sale, subject to availability.  Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations.  A delivery fee will be charged for each order placed by you and will be calculated at completion of your order and stipulated prior to checkout.

Payment
GreaterGood South Africa.co.za, The GreaterGood South Africa Trust and/or The Good Shop shall be authorised to debit the amount payable by you for donations made and/or products ordered against the authorised Payment Card or Points Programme supplied by you when completing your order.  The GreaterGood South Africa entities shall be entitled to debit your Payment Card on confirmation or your donation and/or acceptance of your order and prior to delivery of any products.

By submitting your order and Payment Card details you warrant that you are over the age of 18 (eighteen), are authorised to make payment with the Payment Card and that there are sufficient funds available to pay for the order.

Confirmation of Orders
Orders placed through The Good Shop constitute your offer to purchase subject to this Agreement. Your offer is deemed to have been accepted by The Good Shop when our customer service representatives obtain the relevant items from the supplying organisations unless they are otherwise notified. Failure by The Good Shop to formally confirm or notify acceptance shall not affect the validity of the sale or the enforceability thereof.

Cancellations Policy
If for any reason you would like to cancel an order made with The Good Shop, this may be done by contacting our Customer Services on 021 794-0580 or emailing . You will only be able to cancel orders up to 16h00 on the day prior to the date of delivery.

• No cancellations can be accepted on the day of delivery of an item purchased in The Good Shop.
• No penalty charges will be levied against orders cancelled more than one day prior to delivery of an item.

If you cancel your payment for any reason or if your Payment Card should cease to be valid for whatever reason, you will nevertheless be bound to pay to The Good Shop the full invoice price for items purchased, including all costs incurred by The Good Shop relating to the recovery thereof.

Without prejudice to any other rights or remedies in law, The Good Shop shall be entitled to cancel forthwith any sale and/or your registration if you should breach any of your obligations.

Delivery Policy
The Good Shop delivers from Monday to Friday, excluding public holidays.  Deliveries will be effected within 3 to 5 working days following the completion of your order from The Good Shop, depending on the various supplying organisations which may be in anything from 5 days to 6 weeks.  The Good Shop will notify you in advance of the order period for your items and the expected date of delivery.

On delivery of the order to the specified delivery address, you will receive a delivery note from The Good Shop showing the items delivered, any non-available items, the delivery fees, Value-Added Tax and the amount to be, or that has been, debited from your Payment Card.

For verification purposes, the person accepting delivery at the delivery address may be required to produce a form of identification.  Any person other than yourself who receives the products at the delivery address is conclusively presumed to be authorised to accept delivery on your behalf.
 
Should no-one be in attendance at the time of delivery, the courier will retain the products and a notice will be left at the delivery address to this effect. The courier will contact you to make new arrangements for delivery or collection.
 
The Good Shop and its couriers reserve the right to charge an additional delivery fee should it be required to make a further delivery or collection if no one is at the delivery address to receive the products or hand over the returned products, as the case may be. 

The Good Shop and its couriers' liability for failing to deliver the products on the day indicated to or by, or at all, is limited to the products being delivered at a later agreed time at no additional charge.

You are required to ensure that either you or a duly authorised person shall be in attendance at the delivery address so that appropriate access is available. On delivery, the person accepting delivery shall be required to sign and print his/her name as against a duplicate copy of the delivery note, to confirm receipt of the delivery.

The Good Shop has outsourced all delivery and collection arrangements.  Accordingly, The Good Shop shall not be liable for any damage suffered or loss incurred by reason of any acts or omissions of the deliverer, its directors, employees, sub-contractors, agents, representatives and/or affiliates.

Deliveries outside South Africa (international)
At present The Good Shop is not able to automatically process international deliveries as the variety of delivery tariffs, including customs and/or tax charges, have not yet been determined.  However, if you would like to order any items from The Good Shop for international delivery, please email us at with the items you would like to purchase and we will forward you an individual quote for your products, including international delivery and customs tariffs.

Returns Policy
If you want to return an item purchased on GreaterGood South Africa.com, simply email us at with the following information and we will arrange to collect the item and refund you accordingly.

1. Details of the item(s) you would like to return from the order you made.
2. Your original order date and invoice number
3. The reason for the return
4. The item collection address and time for collection (working hours only)
5. Details of the credit card number or loyalty programme account to be credited.

The following terms apply to returns of items purchased in The Good Shop:

• All items returned will be inspected prior to refund. 
• Proof of purchase is required for all returns. 
• Price paid by the customers is the price on which the refund is based. 
• Items purchased can be returned for a refund, replacement or exchange, provided proof of purchase is provided. 
• All returns will be subject to an administration and handling fee. 
• A collection fee is charged for collections due to customer error. 
• A collection and redelivery fee will be charged where a return is refused. 
• Returns will be refused in the following circumstances: 
•  Where an item has been tampered with, altered or damaged in any way. 
• Where a return is deemed to be unreasonable, this will be referred to management for resolution. 
• We can only replace a product with the same type of product.

Please note:

• If your purchase was made with loyalty points, your refund will be effected in loyalty points.
• If no one is at the collection address at the appointed collection time, an additional handling fee will be charged.
• A collection and redelivery fee will be charged where a return is rejected.

By using our site, you agree to the terms of the above Returns Policy.
 

Risk and Ownership
Risk in the products shall pass to you upon delivery at the delivery address or to the person accepting delivery on your behalf, if for instance you should not be available to take delivery at the delivery address.

Until payment is received in full for any goods sold, ownership in the products shall remain with The Good Shop and/or its supplying organisations, and such products shall be returned and/or surrendered to The Good Shop and/or its supplying organisations following receipt of a default notice from The Good Shop or any other GreaterGood South Africa entity.
